These Terms of Service ("Terms") govern your use of www.tsabusa.cards and purchases from Tsabusa Cards LLC ("Tsabusa Cards," "we," "us," or "our").
By using our website or placing an order, you agree to these Terms and the policies referenced below.
About Tsabusa Cards
Tsabusa Cards LLC is a Florida retailer of trading card games, collectibles, accessories, and related merchandise.
Product selection and availability may change at any time.
Eligibility to Purchase
By placing an order, you represent that:
- you are legally permitted to enter into the transaction;
- the information you provide is accurate and complete;
- you are authorized to use the payment method provided;
- your purchase is for a lawful purpose.
If you are under the age of majority in your jurisdiction, you may use our website only with the involvement or permission of a parent or legal guardian.
Products and Availability
We make reasonable efforts to display product names, descriptions, images, prices, quantities, language, condition, and other relevant information accurately.
Because collectible inventory can change quickly, we reserve the right to:
- limit quantities;
- correct product or pricing errors;
- update product information;
- cancel or reject orders when inventory is unavailable;
- discontinue products;
- limit transactions when reasonably necessary to prevent fraud, abuse, pricing errors, or inventory issues.
If we cancel a paid order that cannot be fulfilled, the affected amount will be refunded to the original payment method.
Product Images and Variations
Product images are provided to identify merchandise but may not reflect minor packaging revisions, manufacturer updates, promotional markings, or other cosmetic variations.
For randomized or assorted products, the specific design, card, character, artwork, packaging, rarity, or collectible result is not guaranteed unless the product listing expressly states otherwise.
Trading Card Game Products
Sealed TCG products are final sale and are not eligible for standard return or exchange, except as provided in our Refund & Return Policy or where required by law.
Opening, altering, or breaking the factory seal makes a sealed TCG product ineligible for standard return or exchange.
Live Rip & Ship Products
Products clearly identified as live rip, live opening, Rip & Ship, or similar services are intended to be opened by Tsabusa Cards on the customer's behalf during or in connection with a live stream.
By purchasing such a product, the customer authorizes Tsabusa Cards to open the product.
Once opened, a live-rip product is final sale and cannot be returned or exchanged because of contents, card value, pull results, rarity, or customer preference.
Verified fulfillment errors remain subject to our applicable policies.
Pricing
Prices are displayed in U.S. dollars unless otherwise stated.
Prices may change before an order is placed. The price presented at checkout is the applicable purchase price, subject to correction of obvious pricing, technical, or inventory errors.
We may cancel and refund an order affected by a material pricing, technical, or inventory error.
Taxes
Applicable taxes may be calculated and collected during checkout based on the order, shipping destination, and applicable law.
Customers remain responsible for taxes or charges that legally apply unless they are collected by Tsabusa Cards at checkout.
Payment
Payment must be successfully authorized before an order is processed unless another arrangement is expressly offered.
Available payment methods are displayed at checkout.
Payments may be processed by Shopify and other payment providers. Processing times and policies of banks, card issuers, and payment providers are outside Tsabusa Cards' control.
Order Acceptance and Cancellation
An order confirmation acknowledges receipt of an order but does not guarantee fulfillment.
We may cancel or reject an order when reasonably necessary because of:
- inventory shortages;
- pricing or listing errors;
- payment authorization problems;
- suspected fraud or abuse;
- shipping restrictions;
- duplicate or otherwise problematic transactions;
- other circumstances that prevent us from reasonably completing the order.
If Tsabusa Cards cancels a paid order, the applicable amount will be refunded to the original payment method.
Customer cancellation or modification requests are not guaranteed after an order enters processing, fulfillment, or shipment.
Preorders
Products identified as preorders are sold before inventory is available for immediate shipment.
Release and fulfillment dates are estimates unless expressly stated otherwise and may change due to manufacturers, distributors, allocations, transportation delays, or other circumstances outside our control.
Any preorder-specific terms displayed on a product page form part of the conditions of that purchase.
Shipping
Shipping terms, processing times, risk of loss, carrier delays, lost shipments, delivery claims, transit damage, and shipping-related responsibilities are governed by our Shipping Policy.
Customers are responsible for providing a complete and accurate shipping address.
A carrier-confirmed delivery does not automatically qualify for a refund, replacement, credit, or reshipment.
Returns, Refunds, and Exchanges
Returns, refunds, exchanges, final-sale restrictions, shipping-related claims, incorrect items, and fulfillment errors are governed by our Refund & Return Policy.
Approved refunds are issued to the original payment method.
Manufacturer Defects
Manufacturer defects unrelated to shipping or fulfillment may be subject to the applicable manufacturer's warranty or replacement program.
Fraud, Abuse, and Chargebacks
You may not misuse our website, payment systems, promotions, returns, refunds, chargebacks, or customer-service processes.
Submitting false information, using an unauthorized payment method, making a knowingly false non-delivery claim, or initiating a payment dispute for a transaction that was properly fulfilled may constitute fraud or abuse.
Tsabusa Cards may preserve and provide relevant order, shipment, tracking, communication, account, and transaction records to payment processors, financial institutions, carriers, law enforcement, or other appropriate parties when responding to disputes, fraud investigations, or legal requests.
Nothing in this section limits any right a customer may have to submit a legitimate payment dispute under applicable law or payment-network rules.
Intellectual Property
The Tsabusa Cards name, branding, website design, original graphics, text, and other original Tsabusa Cards content may not be copied, reproduced, distributed, or commercially used without permission except as permitted by law.
Third-party trademarks, product names, characters, artwork, and logos remain the property of their respective owners.
The sale or display of third-party merchandise does not imply ownership of, sponsorship by, endorsement by, or affiliation with the applicable brand unless expressly stated.
Third-Party Services and Links
Our website may use or link to third-party services, including Shopify, payment processors, shipping carriers, social media platforms, and technology providers.
Third-party services may have their own terms and privacy practices. Tsabusa Cards is not responsible for unrelated third-party websites or services that we do not control.
Prohibited Uses
You may not use our website or services to:
- commit fraud or another unlawful act;
- submit false or misleading information;
- attempt unauthorized access to our systems;
- introduce malicious software or harmful code;
- interfere with website security or operation;
- scrape, copy, or exploit website content in violation of applicable law;
- abuse payment, promotion, return, refund, chargeback, or support processes;
- use payment methods without authorization.
We may restrict access or cancel transactions when reasonably necessary to protect customers, Tsabusa Cards, or our service providers from suspected fraud, abuse, or security risks.
Website Accuracy and Availability
We make reasonable efforts to keep our website accurate and available.
Information may occasionally contain errors or omissions involving products, availability, pricing, promotions, shipping, or other content. We may correct such errors when discovered.
We do not guarantee uninterrupted website availability. Temporary interruptions may occur due to maintenance, technical issues, third-party outages, or circumstances outside our reasonable control.
Collectibles and Market Value
Collectible products may fluctuate in secondary-market value.
Unless expressly guaranteed in writing, Tsabusa Cards does not guarantee future value, resale value, investment performance, pull rates, rarity outcomes, or appreciation of any collectible product.
Disclaimer
To the maximum extent permitted by applicable law, products and website services are provided subject to any warranties and consumer protections that cannot legally be excluded.
Nothing in these Terms is intended to waive or limit rights that cannot lawfully be waived.
Limitation of Liability
To the maximum extent permitted by applicable law, Tsabusa Cards is not liable for indirect, incidental, special, punitive, or consequential losses arising from use of the website or purchase of merchandise where such liability may legally be limited.
Nothing in these Terms limits liability where such limitation is prohibited by applicable law.
Indemnification
To the extent permitted by law, you agree to indemnify and hold Tsabusa Cards LLC harmless from claims, damages, losses, or expenses arising from your unlawful misuse of our website, fraud, infringement of another person's rights, or material violation of these Terms.
Severability
If any provision of these Terms is determined to be invalid or unenforceable, the remaining provisions will continue in effect to the extent permitted by law.
No Waiver
Failure by Tsabusa Cards to enforce a provision of these Terms on one occasion does not waive our right to enforce that provision later.
Governing Law
These Terms are governed by the laws of the State of Florida, United States, without regard to conflict-of-law principles, except where applicable consumer law requires otherwise.
Changes to These Terms
We may update these Terms to reflect changes to our business, website, services, or legal obligations.
